The U.S. Chamber filed an amicus brief urging the D.C. Circuit to hold that EPA guidance, creating binding new requirements under the Resource Conservation and Recovery Act, is judicially reviewable final agency action that must comply with the Administrative Procedure Act. Elbert Lin and Nash E. Long of Hunton Andrews Kurth LLP and the U.S. Chamber’s Litigation Center served as co-counsel for the U.S. Chamber.
