Second Circuit vacates as moot Occupational Safety & Health Review Commission decision that clarified employers’ ability to rebut OSHA citations for “repeated violations”

The court held that the Commission’s decision had been mooted by the cited employer’s bankruptcy. The U.S. Chamber had filed an amicus brief urging the court to affirm the Commission’s decision.
