U.S. Chamber files coalition amicus brief
March 31, 2023
The coalition amicus brief urges the New York Supreme Court, Appellate Division to uphold a trial court ruling that Uber’s terms and conditions requiring arbitration of passenger disputes did not breach ethical rules and are valid and enforceable in passenger personal injury actions; and that the Federal Arbitration Act precludes more restrictive state-law tests for enforceability of arbitration agreements.
Andrew J. Pincus, Archis A. Parasharami, and Daniel E. Jones of Mayer Brown LLP and the U.S. Chamber’s Litigation Center served as co-counsel for the U.S. Chamber.
