U.S. Chamber files amicus brief regarding rigorous analysis of class certification pleading standards

In its brief, NCLC urged the Arkansas Supreme Court to reverse the trial court’s class certification ruling of a nationwide class challenging the manufacture and sale of electric blankets. In particular, NCLC argued that variations in state law precluded the requisite predominance finding under Arkansas’ class action ruling. For a class action to be properly certified, the class members must have the same legal rights across the board. Anything less would deprive the defendant of adequately distinguishing those plaintiffs who are deserving of recovery from those who are not.
