U.S. Chamber urges Ninth Circuit to affirm heightened scrutiny for class action litigation ruling

The Chamber filed an amicus brief in the Ninth Circuit in a case in which plaintiffs seek certification of class actions alleging that the defendants misclassified their distributors as independent contractors instead of employees. The brief explained that plaintiffs’ claims implicate significant individualized issues, including those presented by a nine-factor independent contractor test.
