Concerned about the district court’s end-run around the procedural requirements of the Federal Rules of Civil Procedure, the NCLC requested the 11th Circuit to grant a writ of mandamus and order the district court to safeguard the defendant’s Seventh Amendment right to a jury trial and to comply with the requirement that class actions certified under Rule 23(b)(2) be restricted to injunctive relief only.
