U.S. Chamber files coalition amicus brief
May 18, 2022
The coalition amicus brief explains that class treatment is inappropriate for fraud claims requiring individualized showings of reliance, causation, or materiality, as well as for warranty claims requiring individualized manifestation of an alleged defect. Idiosyncratic preferences and experiences relating to such goods will predominate over any common questions.
Brian D. Schmalzbach of McGuireWoods LLP and the U.S. Chamber’s Litigation Center served as co-counsel for the U.S. Chamber.
