The California Supreme Court declined to clarify what criteria courts should use when deciding whether to certify a class under California’s Unfair Competition Law (UCL).
U.S. Chamber files amicus letter on class certification standards in Unfair Competition Law claims

NCLC urged the California Supreme Court to review whether class certification requirements are applicable to Unfair Competition Law (UCL) claims. Lower courts’ conflicting decisions have made it unclear whether class certification standards apply in UCL claims. In its letter, NCLC argued that trial courts must have flexibility to reconsider certification decisions. NCLC warned that more guidance is needed because the state’s court system faces an increasing flood of class action filings every year.
