The Petitioners Group filed a motion to withdraw its petition for review. NCLC and the other members of the Petitioners Group remained intervenors resisting the challenge to the balance of the rule in American Farm Bureau Federation, et al. v. EPA.

The Fine Particulate Matter Petitioners Group (Petitioners Group) filed a petition for review of EPA’s revised National Ambient Air Quality Standards for Particulate Matter, which modified the 24-hour standard for particulate matter under the Clean Air Act. EPA’s last review of particulate matter air quality standards was completed in 1997 and subsequently challenged by the Chamber and others in Whitman v. American Trucking Association, which was ultimately heard by the Supreme Court.
