U.S. Chamber files amicus brief supporting ERISA preemption of state laws regulating plan structures and disclosures

In a case remanded by the Supreme Court in light of Rutledge, the U.S. Chamber’s amicus brief supported application of well-settled ERISA preemption law to preserve the ability of plan sponsors to offer nationwide employee benefits that can be provided and administered in a uniform manner from state to state, and avoid a patchwork of state requirements that would decrease efficiency and increase plan costs.
