U.S. Chamber urges Nevada Supreme Court to reconsider judgement against Goodyear
July 26, 2010
NCLC urged the Nevada Supreme Court to reconsider its judgment against Goodyear and allow the company to defend itself in court. In this case, the Nevada Supreme Court ordered Goodyear to compensate the families of victims involved in a rollover accident. Goodyear was precluded from showing that the tire in question was not defective and that its tire did not cause the accident. NCLC argued that the trial court sanction striking Goodyear’s defense violated the company’s due process rights. NCLC warned that the court’s decision encourages the trial bar to employ abusive “litigation by sanction” trial strategies.
