U.S. Chamber urges California Supreme Court to review statute of limitations case

In its amicus letter, the U.S. Chamber urged the California Supreme Court to vacate the judgment of the appellate court and remand for reconsideration in light of this Court’s decision in Tuolumne Jobs & Small Business Alliance, which confirmed the longstanding “strong presumption against repeal by implication” of a statute. The brief argued that if left to stand, the decision will instruct other courts that it is easy to find an implied repeal and that the rigorous test endorsed for such a finding is not necessary.
In the alternative, the brief urged the court to order the appellate court’s decision not to be published in the official reports.
