U.S. Chamber urges Indiana Supreme Court to review decision on admissibility of expert witness decision

In its brief, the U.S. Chamber urged the Indiana Supreme Court to review a lower court decision subjecting “engineering” expert testimony to less scrutiny than “scientific” expert witnesses. The Chamber argued that the lower court’s decision is out of line with the overwhelming practices of other state courts to act as a gatekeeper for all kinds of expert testimony. The Chamber’s brief further argued that it is important for Indiana courts to subject all expert testimony to rigorous scrutiny, to ensure that state courts do not become a magnet for litigation featuring unreliable expert testimony.
The Chamber filed this brief jointly with the National Association of Manufacturers and Indiana Chamber of Commerce.
