U.S. Chamber files amicus brief
October 17, 2016
The U.S. Chamber and American Fuel & Petrochemical Manufacturers filed an amicus brief urging the Superior Court of to review a case addressing a state law which purports to subject every foreign corporation that qualifies to do business in Pennsylvania to general personal jurisdiction, which is in conflict with the U.S. Supreme Court’s holding in Daimler AG v. Bauman. The brief argued that Pennsylvania may not subject foreign corporations to general jurisdiction based solely on their registration to do business. Furthermore, the issue warrants immediate interlocutory review because the jurisdictional statute harms citizens and companies in the state.
Robert L. Byer and Andrew R. Sperl of Duane Mooris LLP served as co-counsel for the amici, along with Andrew J. Pincus and Archis A. Parasharami of Mayer Brown LLP.
