U.S. Chamber urges Ohio court to halt no-injury class actions that risk arbitrary class-wide damages awards

The U.S. Chamber and Ohio Chamber of Commerce filed an amicus brief urging the Ohio Supreme Court to hold that plaintiffs seeking class certification must prove that all members of the proposed class suffered an injury-in-fact, and must produce a damages model that measures damages on a class-wide basis and is consistent with plaintiffs’ theory of liability.
