The U.S. Chamber filed an amicus brief urging the Ninth Circuit to affirm a district court decision that rejected an Equal Pay Act claim based on the theory that an employer had an affirmative obligation to eliminate disparity in pay that stemmed from neutral policies at the time of hiring. The brief explained that significant policy reasons weigh in favor of continuing to allow employers to differentiate employee compensation according to gender-neutral guidelines, including adhering to the principles of meritocracy that have driven private sector compensation practices for decades.
The Equal Employment Advisory Council and National Federation of Independent Business Small Business Legal Center joined the Chamber in filing this brief.
