U.S. Chamber files coalition brief urging California Court of Appeal to vacate injunction
December 01, 2020
The U.S. Chamber filed a coalition amicus brief urging the California Court of Appeal to vacate the injunction because Instacart drivers do not qualify as employees under the ABC test and because California voters recently passed Proposition 22, exempting app-based delivery drivers from A.B. 5.
Eric Tung and Craig E. Stewart of Jones Day and the U.S. Chamber’s Litigation Center served as co-counsel for the U.S. Chamber.
