U.S. Chamber urges District Court to rule against attorney general use of contingency fee arrangements

In its brief, the U.S. Chamber urged the U.S. District Court for the District of New Jersey to rule that the contingency fee arrangement between the Mississippi Attorney General and a plaintiffs' law firm violates the Due Process Clause of the Constitution by effectively outsourcing the state’s enforcement authority to a self-interested law firm. Additionally, the government counsel's alleged “control” over the case cannot cure the structural problem with financially self-interested prosecutors.
