Indiana Supreme Court declines to clarify scope of respondent superior liability

U.S. Chamber files amicus brief

In its brief, the U.S. Chamber of Commerce argued that the Indiana Supreme Court should grant Walgreen’s petition and review the case. The brief argues that imposing liability under the doctrine of resondeat superior is only permited if an employee’s wrongful acts were undertaken to further the interests of her employer, and therefore should not apply.
