U.S. Chamber files amicus brief urging dismissal of secondhand asbestos exposure lawsuit
September 18, 2009
NCLC urged the Ohio Supreme Court to dismiss a lawsuit seeking to expand liability for secondhand asbestos exposure. In this case, the plaintiff handled her husband’s work clothing, which had been exposed to asbestos at a Goodyear facility. Two lower courts dismissed the plaintiff’s claims, noting that an Ohio law clearly restricts liability for secondhand asbestos exposure. In its brief, NCLC warned that dramatically expanding liablity for secondhand asbestos exposure would subject thousands of individuals and companies to potentially devastating litigation.
