U.S. Chamber urges Ohio Supreme Court to uphold constitutionality of Ohio Tort Reform Act

The U.S. Chamber filed a brief urging the Ohio Supreme Court to uphold the constitutionality of Ohio’s tort reform law. The plaintiff in this case charged that Ohio’s legislature violated the separation of powers by intruding on the judiciary’s historic province to articulate the common law of torts. In its brief, the Chamber countered that this judicial power was delegated by the legislature at Ohio’s founding and that the legislature continues to have the power to enact tort law.
