Maryland Court of Appeals rejects attempt to displace 160 years of settled law and upholds defense of contributory negligence

The Maryland Court of Appeals declined to abrogate the defense of contributory negligence in certain types of tort actions.

NCLC urged the Maryland Court of Appeals to reject the plaintiffs' call to overrule 160 years of settled law to replace the doctrine of contributory negligence with comparative negligence. NCLC argued that Maryland businesses would be adversely affected by such a seismic shift to comparative fault, putting them at a competitive disadvantage in the region at a time when many are already facing hardships.
