U.S. Chamber urges New York Supreme Court to restore practice of deferring punitive damages claims in asbestos litigation

The U.S. Chamber and a broad coalition of business groups filed an amicus brief urging the New York Supreme Court to modify the June 2017 New York City Asbestos Litigation (“NYCAL”) case management order to restore the longstanding NYCAL practice of deferring punitive damages claims in asbestos cases.
The Business Council of New York State, Lawsuit Reform Alliance of New York, New York Insurance Association, Inc., Northeast Retail Lumber Association, Coalition for Litigation Justice, Inc. National Association of Manufacturers, NFIB Small Business Legal Center, American Tort Reform Association, Washington Legal Foundation, and American Insurance Association filed the brief jointly with the U.S. Chamber.
Victor E. Schwartz, Mark A. Behrens, and Philip S. Goldberg of Shook, Hardy & Bacon L.L.P. served as co-counsel for the amici.
