U.S. Chamber files amicus brief addressing objective consumer expectations test

NCLC urged the Nevada Supreme Court to hold that the trial court should not have excluded expert evidence of consumer expectations, and should not have allowed a design defect determination to be based on the product user's subjective product expectations. NCLC argued that a subjective consumer expectations test would expand absolute liability, leading to insurability problems and raising due process concerns.
