NCLC urged the Colorado Supreme Court to reject an excessive punitive damages award against Qwest Corporation. A Colorado appeals court awarded the plaintiff in this case $21.5 million in compensatory damages and $18 million in punitive damages after the plaintiff fell while working on a utility pole. In its brief, NCLC argued that the punitive award is far too high as Qwest does not have a history of noncompliance with utility pole safety regulations. NCLC warned that excessive awards discourage participation in certain economic activities.
