Ruth Demeter, Senior Director of Policy at the U.S. Chamber’s Global Energy Institute, issued the following statement regarding the publication in the Federal Register of the Migratory Bird Treaty Act (MBTA) final rule:

“The Fish and Wildlife Service’s announcement creates unpredictability for businesses operating in good faith under the Migratory Bird Treaty Act (MBTA) and will only serve to delay the modernization of critical infrastructure needed to meet the administration’s build back better and climate goals. It is unfair to target businesses that are operating in good faith, in particular, when wildfires and other threats have significantly more impact on migratory bird populations. The conservation of migratory birds is important to businesses operating across all industries and businesses have and will continue to invest in conservation practices to minimize impacts to migratory birds that are incidental to their activities.”
